Service Description
New Hampshire Pest Control provides professional pest management services throughout the State of New Hampshire, including residential, commercial, and industrial properties. Our services encompass inspection, identification, treatment, prevention, and monitoring of common pests found in New England, including but not limited to termites, carpenter ants, rodents, bed bugs, wasps, bees, ticks, mosquitoes, spiders, and various wildlife species. Treatment methods may include chemical applications, baiting systems, mechanical controls, exclusion techniques, and integrated pest management (IPM) strategies tailored to specific property conditions and environmental factors. Service frequency varies based on pest type, infestation severity, property characteristics, and seasonal pest pressures typical to New Hampshire's climate. We schedule appointments during standard business hours, with emergency services available for urgent situations at our discretion. All service agreements are established through written proposals or work orders specifying scope, pricing, and estimated duration. We reserve the right to modify treatment protocols based on field observations, regulatory requirements, or product availability without prior notice.
No Guarantee or Warranty
New Hampshire Pest Control does not guarantee complete eradication of pests or permanent prevention of future infestations. Pest biology, environmental conditions, neighboring properties, structural vulnerabilities, and client compliance with recommendations all influence treatment outcomes. We warrant that services will be performed in a professional manner consistent with industry standards by licensed and trained technicians. This limited performance warranty does not extend to damage caused by pests before, during, or after treatment, nor to re-infestation occurring after service completion. Wood-destroying insect treatments carry specific warranties only when explicitly stated in separate written agreements. We make no representations regarding health outcomes or disease prevention resulting from our services. No oral promises or statements supersede these written terms. Client remedies are limited to re-treatment or refund of fees paid for the specific unsatisfactory service, at our sole discretion.
User Responsibilities
Clients must provide accurate property information, disclose known pest conditions, and inform technicians of health concerns, allergies, pets, or sensitive areas before service. Properties must be accessible at scheduled times; missed appointments may incur cancellation fees. Clients must follow all pre-treatment and post-treatment instructions, including vacating premises when required, removing food and pet items, avoiding treated areas for specified periods, and maintaining sanitation standards that support pest management efforts. Structural repairs, moisture control, and habitat modification recommendations must be completed promptly for optimal results. Clients are responsible for securing valuables, covering aquariums, and notifying neighbors of exterior treatments when appropriate. Failure to comply with these responsibilities voids any service warranties and may result in additional charges for callback services. Clients must obtain necessary permissions for treatment of rental properties, shared buildings, or properties with multiple owners.
Limitation of Liability
To the maximum extent permitted by New Hampshire law, New Hampshire Pest Control's total liability for any claim arising from our services shall not exceed the amount paid by the client for the specific service giving rise to the claim. We are not liable for incidental, consequential, special, or punitive damages, including property damage, lost profits, personal injury, emotional distress, or business interruption, regardless of whether such damages were foreseeable. We are not responsible for damage to landscaping, wells, septic systems, or outdoor features unless caused by gross negligence. Our liability for pesticide application damage is limited to compliance with product label requirements and applicable regulations. We carry general liability and workers' compensation insurance as required by New Hampshire law; certificate of insurance available upon request. Claims must be reported within thirty days of service completion or discovery of alleged damage.
Intellectual Property
All content on our website, marketing materials, service reports, treatment diagrams, photographs, and proprietary methodologies are the exclusive property of New Hampshire Pest Control. Clients receive limited, non-transferable rights to use service documentation for their personal or business records only. No client may reproduce, distribute, modify, create derivative works from, or commercially exploit our materials without express written consent. Our trade names, logos, service marks, and slogans are protected under applicable trademark laws. Technical information disclosed during service remains our confidential proprietary information. Client testimonials provided to us may be used in marketing with identifying information redacted unless otherwise agreed in writing.
Governing Law
These Terms of Service and all disputes arising from our services shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to conflict of law principles. Any legal action must be brought exclusively in the state or federal courts located in Hillsborough County, New Hampshire, or the county where the services were performed. Both parties consent to personal jurisdiction in these venues. The prevailing party in any dispute shall be entitled to recover reasonable attorneys' fees and costs. If any provision is held invalid, remaining provisions continue in full force. These terms constitute the entire agreement between the parties regarding our services and supersede all prior communications.
Changes to Terms
We reserve the right to amend these Terms of Service at any time without individual notice to current or former clients. Updated terms become effective immediately upon posting to our website with a revised effective date. Continued use of our services after changes constitutes acceptance of modified terms. Material changes affecting ongoing service agreements will be communicated to active clients with at least fifteen days' notice where practicable. Clients should review these terms periodically. Previous versions are available upon request. No waiver of any term shall constitute ongoing waiver. Our failure to enforce any provision does not waive our right to enforce it subsequently.
